This Privacy Policy explains how Rare Tech Enterprises Ltd. (“RARE REALTOR”, “we”) collects, uses, discloses, and protects personal information when you use our website, apps, and services (the “Service”). RARE REALTOR is built for Canadian real-estate professionals and follows the principles of Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

1. Roles: realtor vs. lead data

For the realtors and businesses who subscribe, we act as a controller of your account information. For the contacts, prospects, and clients that a realtor captures or uploads (“lead data”), the realtor is the controller and RARE REALTOR acts as a processor/service provider handling that data on the realtor’s behalf and instructions.

2. Information we collect

  • Account & profile: name, email, phone, brokerage, headshot, brand assets, and settings.
  • Content you upload: property photos and videos, listing details and addresses, logos, voice recordings (for voice features), and other materials you add.
  • Lead data (captured by realtors): a prospect’s name, contact details, optional selfie, where you met, timeline, notes, attachments, and answers they provide.
  • Communications: messages you send or schedule through connected email/SMS channels, and related metadata.
  • Payments: processed by our payment processor (Stripe); we receive limited billing details and subscription status but do not store full card numbers.
  • Usage & device: app activity, feature usage, log data, device/app identifiers, and approximate location when you use address/GPS features.

3. How we use information

We use personal information to: provide and operate the Service; generate, stage, and deliver AI content you request; capture leads and send messages you or your automations initiate from your connected channels; process payments and manage subscriptions; provide support; maintain security and prevent abuse; comply with legal obligations; and improve the Service (including with de-identified or aggregated data). We rely on your consent and on our legitimate interests in operating the Service; you can withdraw consent as described below.

We do not sell personal information, and we do not use lead data for our own marketing. Lead data is used only to let the connected realtor follow up and maintain the relationship.

4. AI processing

Content you submit for AI features (e.g. a photo to stage, a listing to describe, a script to voice) is processed by us and by trusted AI model providers acting as our sub-processors, solely to produce the result you requested. We do not permit these providers to use your content to train their general models where a no-training option is available to us.

5. How we share information

We share personal information only as needed to run the Service:

  • Service providers / sub-processors — cloud hosting and storage, AI model providers, payment processing, mapping/address lookup, and email/SMS delivery — bound to protect the data and use it only for us.
  • With the connected realtor — a lead’s information (including selfie) is shared only with the realtor they connected with.
  • At your direction — e.g. when you publish content to platforms or book a marketplace provider.
  • Legal & safety — to comply with law, enforce our terms, or protect rights and safety.
  • Business transfers — in a merger, acquisition, or asset sale, subject to this policy.

6. Connected accounts

When you connect Gmail, Outlook, or a texting number, we store the access tokens securely and use them only to send the messages you (or your automations) initiate. You can disconnect a channel at any time.

7. International transfers

We and some of our service providers operate in or store data in the United States and other countries. Where personal information is transferred outside your province or country, we use appropriate safeguards and it may be accessible to authorities in those jurisdictions as permitted by their laws.

8. Retention

We keep personal information for as long as your account is active or as needed to provide the Service, then delete or de-identify it within a reasonable period unless a longer retention is required by law (e.g. tax/accounting) or to resolve disputes. When you delete your account, your data is deleted or de-identified, and related records cascade-delete, subject to backups that expire on a rolling basis.

9. Security

We use administrative, technical, and physical safeguards including encryption in transit, access controls, tenant isolation, and least-privilege service credentials. No system is perfectly secure, but we work to protect your information and will notify you and regulators of a breach where required.

10. Your rights & choices

Subject to law, you can access, correct, or delete your personal information and withdraw consent to non-essential processing. Realtors can delete their account and all associated data in-app (Settings → Delete Account) or by contacting us. Leads can ask the realtor they connected with, or contact us, to access or delete their information, and can opt out of messages at any time (e.g. reply STOP to texts or use the unsubscribe link in emails). Realtors are responsible for honouring opt-outs.

11. Children

The Service is for professionals and is not directed to anyone under 18. We do not knowingly collect personal information from children.

12. Cookies & analytics

Our website uses only essential cookies needed for sign-in and security. We do not load third-party advertising or cross-site tracking pixels, and we do not sell personal information.

13. Changes

We may update this policy from time to time; material changes will be posted here with a new “last updated” date.
